Mediator Style & Process Preferences

Almost every case or dispute can be amicably resolved if the parties maintain an open mind and commit to working hard to arrive at a resolution. When a party's perspective initially is not conducive to a successful mediation, I attempt to sensitize the party to the risks of continuing the dispute, as well as to the immediate benefits derived from a prompt resolution. I am not just a "messenger." Instead, I take an active role in assisting the parties to acquire realistic expectations and to gain a better appreciation of the strengths and weaknesses of their litigation positions. I believe that my 35 plus years as an advocate/litigator provides a perspective that is of substantial value to the parties in this process.

Compensation

Hourly Rate: Not provided Daily Rate: $4,500.00 Study Rate: $540.00/hr Cancellation: $4,500.00/Day Cancellation Period: 15 Days Comment: Reimbursement of out-of-pocket expenses. Cancellation policy: $4500 (full day) $2,250 (half day) will be charged if cancelled or postponed less than 15 calendar days prior to the date scheduled for mediation. Half day mediation (up to 4 hours) is $2,250. A full day is up to seven hours a day, including breaks. Mediator will charge time in excess of allocated 1/2 day or full day at the rate of $540. Time spent reviewing documents or discussing the matter with the parties prior to mediation will be charged at $540 per hour. Time spent continuing discussions with the parties after the mediation session will be charged at $540 an hour.
