I strive first to be a patient, engaged listener, so that I can understand what is of importance to the respective parties, and I employ open-ended questioning to stimulate that process. A good mediation process is one centered on disputant autonomy and procedural fairness. I see my role as the mediator, first and foremost, to facilitate a candid, robust and respectful exchange of information. Once the key information has been exchanged, I help the parties determine whether they can find a pathway to resolution. My level of activism is dictated by the desire of the parties, the nature of the dispute and the dynamics of the mediation. I use a range of facilitative and evaluative techniques to test whether the proposals (or lack of proposals) are meaningful and calculated to lead to a resolution of the matter. Based on careful consultation with the attorneys/parties involved, I tailor the structuring of the mediation sessions, and my role in the same, to respond to the particular personalities, interests, damages, etc. at stake.
