Represented contractors, subcontractors, owners, engineers, and sureties in construction disputes involving power plants, chemical plants, cogeneration facilities, dams, excavating projects, underground mining, gas compression facilities, waste water treatment facilities, schools, hospitals, and residences. Approximately 95% of practice has centered around construction disputes. Has represented owners in disputes with builders/developers over residential construction contracts.

Mediated approximately 500 construction cases. The cases have ranged from single-family residences to complex industrial projects such as power plants, airports, and ethanol plants. The cases have involved claims between owner and contractor, contractor and subcontractor, and many have involved claims and crossclaims between the owner, design professionals, contractors, and subcontractors. The cases have ranged in size from a few thousand dollars to 50 million dollars.

The cases have involved change order disputes with regard to the scope of work, delay claims, inefficiency claims, defective work claims, lien claims, payment bond and performance bond claims, deceptive trade practice violations, code violations, environmental clean-up, fraudulent inducement claims, government contract disputes, design errors, differing site conditions, and acceleration claims.

The mediator's role is to facilitate a settlement. I do not view the role as simply carrying numbers between the parties. I try to become familiar with the facts and legal issues involved in the case. In the private sessions, I will challenge a party's position in an effort to help them properly evaluate the strengths and weaknesses of their case.
