Mediation is a process whereby the mediator serves as a neutral and confidential facilitator of settlement discussions between the parties, and not as a judge who determines the outcome or instructs the parties what to settle for. In the role of a facilitator, the mediator utilizes many techniques including cases analysis, risk analysis, case evaluation, and negotiation coaching. Although the parties are the sole determiner of the outcome of the mediation, the mediator must maintain an active role participating in assisting the parties in making those decisions. The mediator must continue to follow up and stay involved with the lawyers if the case did not settle on the day of mediation.
