Disputes include mechanics' liens, stop payment notices, performance and payment bonds, breach of contract, delay, labor disruption/acceleration, extended overhead, extra work, closeout, backcharges, abandonment, termination, construction defect, indemnity and insurance coverage. Designated as expert legal witness in multi-million-dollar construction dispute. Appeared before California Senate Committee advocating construction industry legislation. Participated in drafting construction industry legislation and contract documents. Holds California contractors general contractor license (B) and several specialty contractor’s license (C) categories. Held active California real estate brokers license, and has FAA private pilot’s license. Member of Associated General Contractors and American Subcontractors Association. Construction cases mediated include issues of delay/acceleration, labor disruption, change orders and other payment disputes, and construction defect, with insurance issues.

Mediator Style & Process Preferences

Prefer exchange of mediation briefs, and opening statements by each party at beginning of mediation. All parties need to observe what opposing parties will present at trial or arbitration. Honest and firm feedback of mediator is essential. Expect decision-maker of each party to attend the mediation.

Compensation

Hourly Rate: Not provided Daily Rate: $11,000.00 Study Rate: $950.00/hr Cancellation: $11,000.00/Day Cancellation Period: 30 Days Comment: Travel rate .55 cents per mile over 25 miles. Parking, airfare and hotel charged if required by the location of the proceeding. At the mediator's discretion, and when warranted, reserves the right to enlist assistance from an associate attorney for legal research, memorandums and drafting assistance, to be done at the associate rate of $425 per hour. If a daily rate proceeding commences or continues before or after normal business hours, the mediator reserves the right to charge hourly rate time for the additional time.
