Presently have an arbitration and mediation practice. Previously, and prior to employment as a Hearing Officer with the State of Missouri, was primarily engaged in a general practice with extensive experience in the litigation of real estate and insurance law matters and appeals. 15% of practice was in negligence, mostly on behalf of plaintiffs. While arbitration practice is varied, in recent years it has primarily focused on arbitrating securities disputes and consumer disputes. Served as an arbitrator in numerous consumer disputes involving claims implicating various federal consumer protection laws, such as the Fair Debt Collection Practices Act, the Magnuson-Moss Warranty Act, the Telephone Consumer Protection Act, and the Cable Communications Privacy Act; as well as state law claims alleging violations of the Missouri Merchandising Practices Act, the implied warranty of merchantability, the implied warranty of fitness for a particular purpose, and allegations of common law fraud, among others.

Has served as a mediator for the American Arbitration Association; the United States District Court for the Eastern District of Missouri; the Circuit Courts of St. Louis City and County; as well as various governmental agencies and other mediation providers, such as the United States Postal Service, the Federal Occupational Health Services Administration, and the Missouri Department of Transportation. Was also an Appeals Committee Reviewer (which included serving as a mediator and arbitrator) for an ADR appeals program for a national insurance company. Has mediated over 500 insurance disputes; more than 100 employment disputes; more than 50 condemnation disputes; and numerous personal injury disputes. Further, while serving primarily as an arbitrator in securities disputes, also mediated some securities cases.

Many of the insurance claims have involved variable annuities. Employment claims have generally involved allegations of discrimination, concerning race, gender, and/or age. Although personal injury claims have often been a result of automobile accidents, has mediated some product liability cases. Also mediated an inter-bank sub-prime mortgage dispute involving numerous realized, as well as anticipated claims, which resulted in a global settlement.

Mr. Lyons views mediation as a dispute resolution mechanism controlled by the parties in which the mediator serves primarily as a facilitator. However, if the circumstances warrant, Mr. Lyons feels it is appropriate for the mediator to suggest possible solutions for the parties to consider in attempting to resolve their dispute.
