Acted as fabrication/tolerance expert on a semi-submersible oil platform/rig fabricated in the state of Mississippi & towed to a North Sea location. Previously held a certificate as a qualified residential home inspector & prefabricated mobile home inspector. Very familiar with Central America construction practices and customs including labor quality/productive expectations. Offered opinions on construction accidents involving steel erection and OSHA requirements.

Mediated at least 30 cases concerning structural steel subcontracting matters (involving owners, engineers, contractors, and subcontractors); and at least three cases concerning claims of design document defects (involving owners, architects/engineers, contractors, and subcontractors), which have impacted contractor and/or subcontractor performance and have led to increased cost matters. Mediated multiple residential home construction matters including contractor-owner issues and contractor-owner-subcontractor issues.

Mediated cases involving: concrete forming and placement issues; structural steel estimating, detailing, fabrication and erection issues; delay and disruption claims, both in shop and field; inefficient labor, trade stacking and acceleration issues; and error/omission/coordination issues relating to contract documents. Many construction mediations have involved schedule analysis.

As a mediator, I attempt to take the personalities out of the process and focus on issues. A strong emphasis is placed on actual damages/costs and the weeding out of fluff to get to the core dollars. It is stressed that a thorough understanding of each party's position on the basic issues must be conveyed to the other side so each party can weigh the strengths/weakness of that position. An attempt is made to obtain each side's best and final offer prior to concluding mediation. I am a strong believer in confidentially discussing each party's potential for recovery should mediation be unsuccessful.
