Primarily engaged in general litigation including the above areas of law, as well as condemnation, corporate and domestic relations law matters. Familiar with estates, government contracts, insurance, landlord/tenant, mineral, oil and gas, municipal, real property and zoning and land use law. Oil and gas experience includes lease obligations, having prepared many title opinions and division order title opinions for a variety of entities in the oil and gas industry. For over 25 years, has represented many consumers in many various types of cases. Those cases include real estate contract disputes, credit card disputes, consumer loans, auto purchases and leases, and lease agreements. Has also represented individual plaintiffs against loan companies. Forty percent (40%) of practice is in negligence, 90% on behalf of plaintiffs and 10% on behalf of insurance carriers. Sixty percent (60%) of negligence practice involves auto accident claims. Experience in auto negligence cases since 1978. Also mediates personal injury cases. Thirty percent (30%) of practice is in construction.

The range of mediation experience is quite vast. Mediated personal injury cases with settlement ranges from $1 million to $3 million. The cases include all types of tort claims, from premises liability, car wrecks, and wrongful death claims. Handled many construction cases, including residential construction defect claims against homebuilders as well as contract disputes between both owners and contractors, and contractors and sub-contractors. The amounts in dispute range from relatively little money to multi-million dollar contracts. Experience also includes liability of professionals such as architects and engineers. Has experience mediating property disputes including sales transactions, breach of contract, and eminent domain.

As stated in the previous section related to experience, have mediated construction cases that include issues such as delay damages, failure to perform, design defects and workmanship claims.

My philosophy as a mediator involves utilizing the skills that I obtained through training, but more importantly, the skills that I have acquired as a practicing attorney for 33 years, to assist the parties in resolving their dispute. As a mediator, being neutral in the particular dispute, I am well-positioned to assist the parties in reaching an amicable settlement of their particular problem. My view of the mediator's role is to talk through the facts and applicable law with the parties and their representatives, to help them understand the risk of trial, and more importantly, to assist them in determining what their true goal of resolution may be. I make an effort to engage the parties in the discussion as it is the party's life that is more affected by the outcome of a settlement. Every case is somewhat different as a result of the different personalities of both attorneys and parties, so the mediator must be flexible in his approach to identify the best method for conducting a mediation in any particular case. My primary expectation of the parties is that they focus on the issues at hand and be willing to talk through the issues to seek a reasonable solution.
