Partner at Nishimura & Asahi (Gaikokuho Kyodo Jigyo) and heads the firm’s international dispute resolution practice. Specializes in international commercial litigation, arbitration, and mediation. Has represented many international clients, including multi-national manufacturers, banking and securities firms, insurance companies, and news media organizations in disputes involving M&A, antitrust laws, corporate governance, insurance laws, intellectual property, defamation, joint ventures, licensing, construction, and other commercial matters, as well as international bankruptcy. Has been involved in a number of international arbitrations as counsel and arbitrator (including chair and sole arbitrator).

Represented clients in a number of international litigation and dispute resolution cases regarding product liabilities, infrastructure contracts, distributorship/licensing termination, shareholders agreements, etc. Served as a member of the committee of the Legislative Council of the Japanese Ministry of Justice on Japan’s new statutory rules on choice of law and international jurisdiction in civil litigation, and amendments to Japan’s Arbitration Law. Taught classes on international arbitration, international dispute resolution, and closely held corporations at the University of Tokyo, School of Law. Served as an examiner for the national bar exam of Japan (Commercial Law).

Served as mediator for various matters under various rules, including a fully online ad-hoc mediation on a large and complex commercial dispute where online conferencing with experts was used to assist the parties and also for the mediator to better understand technical issues. Also served as mediator on cases involving financial institutions. Also served as counsel in large and complex international mediation cases, including multi-parties mediations and mediations conducted in U.S.A. and U.K., in relation to disputes litigated in courts in U.S.A. and U.K.

Duties allegedly owed by financial institutions in selling financial products that are suitable for customers. Duties of commercial building lessors in regard to the removal of hazardous materials from the property, and the scope of recoverable damages.

Depending upon the parties’ preference either the evaluative or facilitative approach can be applied, but in most cases parties have shown a preference for the mediator’s evaluation on some of the major disputed issues. Often seeks creative and win-win solutions to maximize the parties’ overall benefits by resolving disputes amicably and smoothly.

Has handled fully online arbitration and mediation cases, including a mediator case involving virtual video conferencing with multiple experts on a complicated real property dispute. Familiar with delay analysis using Primavera software.
