Experience
Over 32 years experience litigating and arbitrating all types of construction, commercial and business disputes. Representative construction experience includes drafting and negotiating construction management, design-build, single prime contractor contracts, and subcontracts. Construction litigation experience includes multi-million dollar claims for delay, acceleration, lost productivity, based upon alleged owner interference, defective plans, differing site conditions, and claims related to defective construction, including personal injury and wrongful death claims.
Business litigation experience includes contract disputes, disputes between partners over ownership and fiduciary duties, corporate minority shareholder rights and representation of franchisees related to franchise agreement terminations and other disputes.
Commercial litigation experience includes litigation and arbitration related to alleged breaches of sales and non-sales contracts, warranty claims, unfair competition, fraudulent representations and practices, protection of trade secrets and enforcement of covenants not to compete.
Product liability experience includes defense of manufacturers of pharmaceuticals in major class actions, defense of commercial and consumer construction tools and equipment, and litigation related to claims of defective tire manufacture and consumer recreational equipment.
Mediator Experience
Served as a certified superior court mediator since 2000. In that time, mediated over 1,200 disputes primarily focused on contract breaches, complex business torts and commercial fraud. Served as a mediator in construction industry disputes, including owner-contractor, contractor-subcontractor, and owner-designer disputes. The issues in mediated construction cases have ranged from contract scope disputes, to defects in design and construction, changed site conditions, and delay and acceleration claims.
Extensive experience mediating commercial disputes ranging from business ownership issues, breach of sales and other contracts, business torts, trade secret violations, and unfair trade practice claims.
Representative Issues Handled as a Mediator
Commercial and business cases mediated include disputed accounting of partnership and minority shareholder interests, breach of contract cases, including defenses of failure to mitigate. Construction disputes mediated have included the following issues: delay, acceleration and lost productivity related to changed conditions, defective plans and specifications, owner interference, and failure to coordinate or supervise.
Mediator Style & Process Preferences
Mediation is perhaps the best opportunity for the parties to understand their case through their opponent's perspective. My goal in every mediation is to ensure that the parties make fully informed decisions. As I see it, my role is to facilitate the flow of information, challenge both sides on their facts and legal analysis and flesh out an understanding of why the opponent has a different perspective.
How a negotiation progresses belongs to the parties but an important part of the mediator's role is to help the parties overcome an emotional reaction to statements or offers and maintain focus on the goal.
I believe strongly that a successful mediation requires thorough preparation by all parties and an ability to not only listen but hear the other side. Through this process, my goal is to ensure that with or without settlement the parties understand the risks of proceeding to trial and gain an appreciation of the value of compromise.
I also believe that negotiation is a skill or set of skills that can be learned. In mediation, I use what I have learned through study and experience to help guide the parties send consistent messages in their offers/demands to maximize the possibility of settlement. Most advocates I have worked with have a very good understanding of the strengths and weaknesses of their case but often need guidance with the negotiation process.
The more thoroughly prepared the advocates in a mediation are the more likely the case is to find a good resolution.
Technology Proficiency
Has conducted hundreds of on-line and hybrid on-line mediations and several arbitrations managing the Zoom platform so that the technology does not interfere with the negotiation or presentation of evidence.
Successfully completed Clearbrief Academy, an AI analysis platform, in May 2025.

Study Rate: $600.00/hr
Cancellation: $2,100.00/Day
Cancellation Period: 14 Days
Comment: If the mediation is cancelled or postponed within 14 calendar days of the scheduled hearing, a postponement/cancellation fee of $2,100 will be charged. Cancellation fee may be waived on a case-by-case basis depending upon the reason for the late cancellation.
