Has practiced law for 47 years. The first half of career focused on both transactions and litigation and trials. Litigation and trials involved primarily commercial matters such as contract actions, construction disputes, bankruptcy adversary actions, real property actions, municipal law and zoning matters, commercial leases and banking matters. Transactional matters consisted primarily of commercial real estate transactions involving acquisitions, dispositions, development, zoning, construction, leasing and structuring, real estate financing, as well as other asset based financing, oil and gas and bank representation. The second half of career has focused more on complex commercial transactions, having turned over most (but not all) of the litigation and trial work to other partners. Involved primarily in structuring and consummating complex transactions in the areas of finance, asset acquisitions and dispositions, insurance and financing arrangements. Clients have included banks and other similar lending institutions, oil and gas firms, pipeline companies, midstream companies, insurance companies, national retail product distribution companies, local and national real estate firms, manufacturing companies and the like.

Mediator Experience

Formerly served as a volunteer Adjunct Settlement Judge for the District Court of Tulsa County, Oklahoma, handling primarily business, contract and real property related cases for over 25 years. Approximately 10 years ago, moved to private mediations and arbitrations.

Representative Issues Handled as a Mediator

Breach of contract issues, real property issues, such as lease, foreclosure, title, purchase and sale, condemnation, easements, etc., business entity issues, including stakeholder disputes, employment disputes.

Mediator Style & Process Preferences

Mediator's philosophy is to aid the parties in focusing on issues significant to their decision to settle and why it is in their best interests to resolve the litigation. Because Mediator's emphasis is in business related litigation, Mediator has found it useful to help focus the parties on risk analysis exercises and cost of litigation and trial, including both legal costs of litigation and internal company costs of litigation.
