Engenders trust in the Mediator and the mediation process by the empowering the parties to find and embrace the terms of settlement that the Mediator identifies for them. Uses techniques of case analysis to assess the strengths and weaknesses of case positions and employs reality checking approach to have the parties and counsel critically and objectively assess the merits of their respective positions. Close the deal by exploring the next best alternative to a negotiated agreement and by emphasizing the benefits of negotiated, voluntary, settlement including less cost, finality and closure of the dispute.
