Handled claims on behalf of and against a wide range of businesses including real estate developers, general contractors, construction managers, subcontractors, suppliers, architects and sureties. Extensive expertise in all aspects of construction and real estate including legal, financial, technical, commercial, contractual, planning and development. Commercial - Over 7 years experience as an Arbitrator and Mediator in Commercial disputes involving financial institutions, private lenders, corporations, partnerships and LLCs involved in development deals, UCC transactions and commercial transactions. Employment - Over 7 years experience as an Arbitrator and Mediator in Employment disputes involving FSLA violations based on wage (minimum wage, OT, spread of hours, liquidated damages, attorney fees, notice violations), compensation (contract, commission) and discrimination claims (ADA violations based on disabilities, Title VII violations based race, ADEA violations based on age, SDA violations based on sexual orientation). Consumer - Over 7 years experience as an Arbitrator and Mediator in Consumer disputes involving credit card companies, financial institutions, car dealerships, short term rental companies and standardized testing companies. Personal Injury - over 15 years as head of my firm's insurance defense practice and over 7 years as an Arbitrator and Mediator in car accident cases involving various injuries (head and neck, disc, shoulder, spine, knee).

Representative issues handled as a mediator have included personal injury, construction disputes, defamation, FLSA and NYLL wage claims, Title VII, NYSHRL and NYCHRL claims.

Successful mediation starts with parties who are invested in the process. The parties can be educated as to the benefit of mediation by the mediator. Once positive motivation is established, enabling the parties to communicate confidentially through the filter of the mediator can prove to be decisive in the success of the mediation. A good mediator should know how to positively message each party so the parties feel that they are driving toward an amicable resolution.
