This also includes construction matters where personal injury claims were asserted.

To serve as an active neutral, and not to simply move room-to-room with an offer and counteroffer. It is vital to review materials, and review each party's position before mediation to ensure that mediation is as productive as possible. A mediator is a neutral. However he/she should be prepared to ask targeted questions to keep the process the moving in a professional manner. A mediator serves an invaluable role in the mediator process, and must be committed to work ethically and actively to try to reach a resolution.
