Over 40 years’ experience as a trial lawyer, including business, commercial, casualty, and errors and omissions matters, and as a construction lawyer, whether representing owners, design professionals, contractors, subcontractors, or material suppliers. Business disputes have included securities cases and a seven-day jury trial regarding the alleged sale of ownership interests in a bank. Construction law experience includes a seven-day jury trial and a five week court trial, representing a precast concrete manufacturer. Issues addressed as a mediator or arbitrator include business break ups and ownership disputes among family members, contested commercial contracts and alleged damages, a dispute between a professional and the professional’s clinic; a dispute among members of a major health care related LLC; disputes regarding claims involving substantial agricultural equipment, claims regarding the operation of a family LLC, and claims against the Trustee of a family trust. Construction issues involved both commercial and residential construction disputes, with various construction industry participants as parties, whether roofs, HVAC, concrete work, flooring, or scheduling and delay issues.

Mediator experience includes varied construction, business and commercial mediations, involving a medical group, a health related LLC, a family trust situation, disputes regarding claims involving substantial agricultural equipment, and basic claims regarding contract performance issues and alleged damages. Commercial issues have included breach of contract for sale of steel products, a dispute among members of a LLC, a dispute between siblings over trust distributions, sale of a business, real estate loan issue, and a vehicle financing issue. Construction issues have included change orders, decisions by architects and engineers, delay or interruption, structural issues, water intrusion, and the reasonableness of proposed remedial actions, as well as general construction and damages issues.

As a Mediator, more recently served regarding a $829,000 claim for steel products, a home owner's $900,000 claim against a residential contractor, a $12,600,000 claim and $3,300,000 counterclaim over construction of a manufacturing facility, a dispute among members of a health care related LLC involving a claim of $9,000,000; and a dispute among claimants to agricultural equipment with a claim of $600,000.

I contact and work with counsel prior to any mediation session. The goal is for the parties to be ready to take their best shot at finding a resolution. This includes making sure that the parties have sufficient information to be able to negotiate realistically and fully. Counsel also can help shape the mediation process. I use whatever mediator approaches promote reaching a resolution, whether raising questions and probing positions, or discussing possible outcomes absent resolution.
