Mediator Style & Process Preferences

Mediation is facilitated negotiations. My role as a mediator is not to be a decision maker but to create an environment for parties to negotiate. It is my job to identify why previous negotiations have failed (i.e. poor communications, high emotions, a good-faith disagreement as to legal outcomes) and to assist the parties in working through their impasse and to identify what interests need to be met to reach a settlement. I would describe my style as a facilitative approach that utilizes tough reality testing as parties consider their legal claims and alternatives to settlement. I have also offered evaluative opinions, when requested by the parties, in some labor grievance mediations and other dispute resolution processes.

Compensation

Hourly Rate: $450.00 Daily Rate: Not provided Study Rate: $450.00/hr Cancellation: $1,800.00/Day Cancellation Period: 10 Days Comment: Minimum hearing fee: 6 hours. Cancellation fee: half-day rate (4 hours) applies if mediation postponed or cancelled with notice of less than 10 days from mediation date, and another matter cannot be set in its place. There is no charge for travel time on the day of mediation. Travel required prior to or following the day(s) of the mediation is billed at $200 per hr, not to exceed the half-day rate. Actual and reasonable expenditures for transportation, meals, lodging and tolls are billed at cost. Travel in the mediator's own vehicle is billed at the applicable IRS rate. No charge for normal office expenses. Charges actual expenses for extraordinary office expenses, such as overnight mail, at the parties' request.
