Experience

Neutral mediator and arbitrator of complex disputes. Former Compliance Officer and General Counsel of large 90 year-old financial institution. Formerly transaction, regulatory, and trial attorney whose private practice primarily focused on complex issues related to financial institutions and other creditors. Significant mediation, arbitration, and litigation experience representing clients in complex bankruptcy, restructuring, and creditors’ rights issues. A significant focus of private practice was advising financial institutions regarding liquidation and servicing of government guaranteed loans. Advised financial institutions on various regulatory matters including regulatory applications and examinations, negotiation of regulatory agreements, and litigation of disputes involving financial institution regulations. Varied transaction experience includes loan origination and workout involving complex lending relationships, and have regularly counseled servicers of securitized commercial loan portfolios in connection with commercial loan origination, assumptions, and defeasances, among others. Substantial experience advising clients and/or arbitrating matters involving manufacturing defect claims, state lemon law claims, Magnuson-Moss Warranty Act claims, and claims involving the Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), Truth in Lending Act (TILA), among others. Informed by practical banking experience, having worked as Compliance Officer/General Counsel of financial institution, and in the Consumer and Small Business Divisions of Bank of America and the Corporate Trust Division of Wells Fargo. Additionally, a graduate and former executive student advisor of the Pacific Coast Banking School at the University of Washington—the Nation’s premier national graduate school of banking. This practical perspective is key to the ability to counsel and interact credibly with institutional clients on sophisticated matters. Former Judge Pro Tem in the Maricopa County Superior and Justice Courts. Have decided hundreds of written motions and presided over hundreds of hearings, bench and jury trials, and evidentiary hearings—in a very wide variety of criminal and civil matters.

Mediator Style & Process Preferences

Mediation is a party-owned and self-determinative process. To that end, a mediator should provide a facilitative, evaluative, or even transformative mediation experience depending on the specific needs and desires of the parties to a dispute. A mediator should, to the extent possible, focus heavily on pre-mediation planning and preparation to ensure time spent in mediation is as effective as possible.

Locations Where Parties Will Not be Charged for Travel Expenses

Willing to serve anywhere in the world. Will not charge for travel time or cost for matters handled in Phoenix, Arizona, Mexico City, Mexico, St. George, Utah, or Puerto Rico. Willing to waive charge for travel time or cost, on a case-by-case basis upon request, for consumer arbitrations.

Compensation
