An effective mediation has no preordained format or structure. Rather, it is the parties’ mediation and accordingly should be organized based on pre-mediation discussion and evaluation to best meet their needs and achieve their objectives. That may entail varying features including use of joint and/or individual sessions, which may be in-person or virtual, as well as follow-up “shuttle diplomacy” and when appropriate, mediator’s proposals. To make any sessions and discussions most meaningful, a mediator should strive in advance to understand the legal and factual issues, as well as the commercial and relationship dynamics. Above all, the process must assure careful listening to the parties’ positions and messages, as well as confidentiality and precision to ensure that all exchanges are accurate and authorized.
