Court Appointed Special Magistrate & Discovery Facilitator: Since 2016, have been appointed by the Delaware Court of Chancery and the Delaware Superior Court in more than 25 lawsuits to assist those courts with discovery disputes, often in high stakes litigations. Extensive experience litigating similar claims under Delaware law as a first chair attorney. Also has a deep understanding of Delaware discovery law, in particular as to issues concerning electronic discovery. Frequently selected by parties to resolve corporate and commercial disputes, particularly those arising out of Delaware law and pending in the Delaware Court of Chancery or Superior Court. Have successfully mediated cases concerning breach of fiduciary duty, breach of contract, breach of restrictive covenant, and litigations arising out of stock or asset purchase agreements. Have successfully resolved cases involving millions of dollars, including disputes where the parties were tens of millions of dollars apart. Disputes have involved two or more parties and insurers.

Mediation is successful when parties gain as much information as possible and can make an informed decision to either compromise or litigate. Use of mediation statements (preferably shared in part or completely) and pre-mediation calls help negotiations begin before the day of mediation. Pre-mediation calls often consist of joint calls with counsel and separate calls with counsel and their clients. During mediation, can be facilitative or evaluative, depending on the need. Will ask questions, will be prepared, and will be inquisitive; will not berate or disrespect the parties or counsel. Draws on experiences as court appointed magistrate and litigation experience in similar matters to aid evaluations.

Familiar with managing ESI and willing to conduct arbitration hearings in-person, via videoconference/teleconference, or hybrid formats. Willing to receive all filings electronically, without need for hard copies.
