More than 40 years' experience in legal matters, including as a justice on the Arizona Supreme Court for 14 years and practice at the law firms later known as Osborn Maledon P.A. and Lewis Roca, as Arizona's Solicitor General, and at the U.S. Department of Justice as a Deputy Assistant Attorney General, special investigative counsel for the Inspector General, and a federal prosecutor.

Fourteen years on the Arizona Supreme Court that involved reviewing cases and writing opinions on a broad range of issues, including attorney ethics, business disputes, contract interpretation, the economic loss rule, partnerships and limited liability companies, professional malpractice, public law issues, real estate, taxation, torts, and water law. Judge Pro Tempore for Division One of the Arizona Court of Appeals in 1998 and 1993 in cases involving contractual and tort disputes. While in private practice, extensive experience in complex litigation, corporate governance, professional liability, financial disputes, Indian law and tribal gaming, insurance, health care, and public law. Criminal law experience as federal prosecutor and judge.

Conducted, over last five years, single and multiday mediations in complex civil matters, including multiparty disputes and public law claims and enforcement actions.

Claims for breach of implied covenant of good faith and fair dealing; commercial torts; ownership and management disputes in close corporations; alternative fuel supply chain disputes; use restrictions in commercial real estate; public law claims related to school finance, civil rights, or antitrust; and issues related to Indian gaming or contracts for tribal health care.

A mediator should help the parties determine if they can identify a mutually acceptable resolution that better serves their interests than proceeding with the risks and costs of litigation. This generally means listening carefully to the parties, learning about the case based on the materials they provide, and tailoring the mediation process to the particular circumstances. In most cases, the parties share pre-mediation position statements and also submit brief confidential statements. Meetings may be held separately with each side before and during the mediation. This process is collaborative, flexible, and most often evaluative.
