Mediator Style & Process Preferences

I am an evaluative mediator who believes I must first engage the emotional aspect of a dispute before addressing the legal issues. At the beginning of a mediation, I spend a lot of time listening to the parties and trying to understand their emotional state. I believe good settlements are processes and not events. I prefer to start with position statements from the parties to understand the dispute and the legal issues. I also prefer to have separate communications with the attorneys before the mediation to determine the current status of the dispute. I find that a brief joint session is helpful if the parties are not overly antagonistic. I spend most of the first portion of a mediation simply listening to the parties. It is vital that the parties believe the mediator is hearing their story and cares about resolving the dispute. Parties are much more likely to be reasonable and rational when the party believes he or she has been heard and understood. Once I believe the parties think they have been heard and understood, I begin the evaluative portion of the mediation. A good settlement depends upon the strengths and weaknesses of the claims and defenses. A neutral and objective opinion can be invaluable in resolving a dispute. I also use several persuasive techniques I have developed over my decades of mediation experience to try and get the parties to volitionally resolve their dispute.
