Has extensive appellate experience in state and federal courts, including the U.S. Supreme Court. Cases ranged from those seeking TROs to those seeking millions in damages. Commercial cases: shopping center and other property leasing; non-competition agreements; construction and architect breach of contract matters; bankruptcy; sale and purchase of businesses; business disputes; financial and professional services industry including broker-dealer disputes; entertainment; secured and unsecured debt. Administrative matters: accreditation and regulatory compliance in the healthcare industry; internal corporate investigations including employee and third party theft. Insurance: coverage disputes; reinsurance matters; Errors and Omissions (E & O); Comprehensive General Liability (CGL); handled first party and third party claims under automobile, health, and homeowner policies. Will contests and probate litigation involving guardianships, conservatorships, will and trust contests, breach of trustee's fiduciary duties. Intellectual Property: handled trademark, trade secrets, and copyright disputes including obtaining temporary restraining orders and preliminary injunctions. Mediator Experience

Mediated consumer and commercial disputes, probate litigation matters including mental capacity, prenuptial agreements and family matters, alleged breach of fiduciary duties, and Title IX matters.

Representative Issues Handled as a Mediator

Representative issues mediated included whether someone had the mental capacity to enter into a prenuptial agreement, whether a contract was valid and enforceable when amended by one party when the other was incapacitated, the amount of damages recoverable in a clear liability case.

Mediator Style & Process Preferences

I approach each mediation with the attitude to assist the parties to a resolution they can feel comfortable with. I stress that parties should drive the process in an open and transparent way and not import the more cumbersome processes that sometimes characterize traditional litigation. I expect the parties to provide mediation summaries and provide pertinent information in advance to aid an efficient process. In the appropriate case, I encourage EDR (Early Dispute Resolution) procedures that often can help the parties assess case value more realistically and streamline the mediation itself.

Compensation

Hourly Rate: $650.00 Daily Rate: Not provided Study Rate: $650.00/hr Cancellation: $1,000.00/Day Cancellation Period: 2 Days Comment: No travel compensation will be sought for the Chicagoland region, actual expenses will be sought both for and outside the Chicagoland region. No cancellation compensation will be sought in case of settlement before the scheduled mediation date.
