As an advocate for more than 40 years in Florida where mediation has been legislatively mandated in every dispute since 1988, I have observed many different approaches to mediation and many different philosophies. As a Certified Mediator now for 15 years. I know that mediation is not a "one size fits all" process. I value and have acquired the ability to understand the reasons for impasse in negotiations, and I spend the time necessary to understand the motivations and personal characteristics of the decision makers involved and employ those techniques best suited to resolving the dispute between those parties. The best statement of my philosophy is that I listen carefully to the parties and their counsel, learn quickly how they view the dispute and then, employ the tools best suited to resolve that specific dispute between those specific parties. Perhaps most important, I am very persistent and do not permit small hurdles to disrupt the path toward resolution of disputes. In every case I attempt to speak with counsel and, where possible, party representatives, well in advance of a formal mediation session. During these early contacts I try to determine what the parties' interests are in the dispute and beyond the dispute. I also ask counsel for the parties to assist me in determining the best procedural approaches for each dispute.
