Practicing lawyer for 12 years, counsel in antitrust jury and bench trials. California Superior Court judge 20 years: seven years in a complex litigation court, two years in writs and receivers, two years as Assistant Supervising Judge Civil, two years in a general jurisdiction civil court and 12 months sitting on assignment in the Court of Appeals, Second Appellate District, Division Three. Extensive experience in healthcare litigation, unfair competition, environmental, products liability, mass torts, personal injury, employment, wage and hour class actions, consumer class actions, entertainment, and professional liability. Chairman, Vice-Chair, and Member of Judicial Council Civil and Small Claims Advisory Committee. As an attorney, specialized in antitrust and trade regulation law. In that practice, represented a number of healthcare clients. Litigated claims asserted by excluded physician groups, and certain benefits and cost monitoring firms, lawsuits arising from disputes between providers and payors of medical and hospital services, allegations that the use of certain medical equipment was used to monopolize integrated markets for reagents and other tests, challenges to non-compete covenants, potential challenge under the Clayton Act to the acquisition of certain hospitals by another hospital. As the Regional Director for the Federal Trade Commission, reviewed and recommended approval of the merger of two regional hospitals in the Central Coast of California. As a bench officer, presided over trials involving malpractice claims against certain hospital employees and physicians, challenges to the removal of certain physician's privileges, and a variety of challenges to the propriety of charges and the adequacy of reimbursements both between provider groups and provider and payor groups. Participated in writ petitions and preliminary injunctions involving these same issues, including disputes regarding credentialing. As a complex judge, supervised significant litigation regarding disputes between providers as to when patients could be transferred and appropriate reimbursement rates. As a Magistrate Judge in the Central District of California, presided over suits alleging an entitlement to certain funds under ERISA and/or Social Security Disability benefits, which required the review and assessment of individual medical records. As a member of the complex litigation panel of the Los Angeles Superior Court, presided over cases involving a number of different provisions in provider contracts, including exclusivity provisions. Also presided over disputes between providers regarding reimbursement of ICU expenses and disputes between providers and payors regarding the scope of applicable coverage and reimbursement. As an independent calendar civil judge on the Superior Court, presided over medical malpractice lawsuits and trials involving nurses and other hospital personnel, as well as physicians. During tenure on the writ and receivers bench, presided over disputes involving peer review and credentialing of medical professionals, and the termination of physicians from medical staffs. In law practice, litigated several cases either challenging or defending exclusive service contracts, claims of a variety of competitive restraints on competition in healthcare (including, without limitation, non-compete provisions, exclusion of certain provider groups, challenges to the use of cost-monitoring services by hospitals, and contracts relating to the acquisition and use of major medical equipment, merger and acquisition of hospitals and joint ventures between hospitals and providers.
