Experience

Nearly 20 years as a Federal Judge, more than 49 years of legal expertise, which includes approximately 25 years as a trial lawyer. Much of judicial service was devoted to mediation and settling the full range of civil disputes.

Mediator Experience

Settled thousands of cases with special experience in Commercial, Contract disputes, Employment (wrongful termination, discrimination, contracts, trade secrets, restrictive covenants), Product liability, Intellectual property (trademark, patent, copyright), Multi District Litigations (MDL’s), mass torts, Class Actions, Insurance, Securities, and other federal and business-related disputes. Over the course of judicial service, thousands of mediations were conducted, resulting in the successful resolution of a significant majority before trial. Since retirement from the bench, mediation services have continued in all types of business disputes. Have also been appointed by Federal Judges as a Special Master mediator in a range of the nation’s largest MDL’s, including mass torts, complex intellectual property matters, and commercial and fee disputes.

Representative Issues Handled as a Mediator

Representative matters include the full range of civil disputes involving commercial, contract, employment and workplace disputes, restrictive covenant and trade secret litigation, intellectual property matters, product liability claims, class actions and multidistrict litigation, insurance coverage, securities matters, and consumer protection matters, and other business torts and complex federal and state court litigation.

Mediator Style & Process Preferences

I take a practical, hands-on, and solutions-oriented approach to mediation, tailoring the process to the nature of each dispute and the motivations of the parties. No single style fits every case, so I adapt my approach based on the circumstances of the matter and the needs of the participants. When appropriate, I provide candid assessments regarding applicable law, litigation risks, and the realities of continued litigation. I will often, though not always, make a mediator's proposal when doing so may help bridge remaining gaps and facilitate resolution. My goal is to be a thoughtful, compassionate, and effective mediator who listens carefully, earns the trust of the parties, and helps guide difficult disputes toward practical and durable resolutions.
