More than 20 years of mediation experience as an advocate primarily involving multiparty construction defect litigation, ADA claims and premises liability.

Representative Issues Handled as a Mediator

Mediation experience as an advocate includes multi-party construction issues such design deficiencies, construction defects (workmanship flaws), subsurface deficiencies, soil settlement issues, and water intrusion, in addition to ADA claims, breach of contract and accidents.

Mediator Style & Process Preferences

Pre-mediation preparation is the key to successful mediation. I encourage the parties to exchange information, and case summaries prior to the mediation, including their position regarding liability and damages. In complex multi-party mediations, it is important that all necessary parties are represented, including the insurance carriers. Early in the process I encourage the parties to find facts upon which all parties agree, to create positive momentum. Then I facilitate narrowing the scope of the dispute. I prefer a collaborative as opposed to an adversarial approach. I find break out caucuses to be effective and will provide my opinion of the respective strengths of the case when the parties believe that it will facilitate a resolution. My experience as In-House Legal Counsel provides an additional perspective and understanding of the parties’ respective businesses as well as their legal position.

Technology Proficiency

Willing to conduct arbitration hearings and mediations using all on-line platforms such as Zoom. In addition, willing to conduct hybrid arbitration hearings and mediations. Willing to receive all submissions and evidence in electronic format (paper submissions are neither required nor desired).
