Extensive experience in civil rights cases defending police agencies in trials and through the appellate process including the United States Supreme Court. Represented employers and employees in cases of discrimination, harassment, retaliation and various statutory and common law causes of action. Represented both consumers and business in various aspects of consumer litigation, including class action defense.

Successfully mediated hundreds of cases, often in employment, civil rights and torts matters, but have experience mediating business and real estate disputes, class action disputes, and consumer litigation. Cases have arisen in both state and federal court (New Mexico and Texas). Many of the mediations conducted involved multiple parties. Listed as a Superlawer in Mediations for the last 10 years.

Representative mediation matters have included: Civil rights disputes, including disputes under 42 U.S.C. sec. 1983; employment disputes asserting violations of civil or statutory rights including allegations of discrimination, harassment, retaliation, and various whistleblower provisions; class action disputes; business "divorces"; many types of statutory and common law tort claims; allegations of violation of consumer protection laws; real estate disputes.

I am always prepared for mediations that I conduct. I will meet with counsel prior to the mediation to ensure that the mediation itself is conducted expeditiously. I will have read and evaluated all of the written materials provided to me by counsel, and use that occasion to discuss, among other things, whether there are additional materials I should review in advance of the mediation. In appropriate cases, I will meet with counsel and their clients in advance of the mediation to ensure that the party is allowed to fully articulate his or her position and to, whenever possible, defuse emotions prior to the commencement of the mediation. In the mediation, I am a careful and engaged listener, and rely upon my trial and substantive experience to advise both sides, upon request, of the consequences of failing to resolve the case. My approach is evaluative, respectful, and cordial. I try to remain mindful that the parties have retained me to help them resolve a dispute so that they can move on in their respective endeavors rather than remaining enmeshed in litigation.

Willing to conduct arbitration hearings and mediations using on-line platforms such as zoom. In addition, with the parties' consent, willing to conduct hybrid arbitration hearings and mediations. Willing to receive all submissions and evidence in electronic format.
