Mediator Style & Process Preferences

After spending decades in litigating / arbitrating disputes, I strongly believe in the value of mediation. First and foremost, I respect party autonomy in mediation process. Mediation style could vary from facilitative to evaluative depending on the parties’ choice. I prefer having separate pre-mediation conference calls with the parties to better understand each party’s position, and also request position papers (both confidential and non-confidential) prior to the mediation. Respective parties’ positions will be shared only upon clear approval from the parties. I also provide a mediator’s proposal for resolution of the disputes should the parties ask for one at the end of mediation and check-in with the parties should the first round of mediation fail.

Technology Proficiency

Familiar with managing ESI and willing to conduct arbitration hearings in-person, via videoconference/teleconference, or hybrid formats. Willing to receive all submissions and evidence in electronic format (paper submissions are neither required nor desired).
