Extensive experience in labor and employment law. Prosecuted claims for employees for six years, then defended employers against claims for another 10 years. Texas Bar’s Corporate Counsel Review published four articles about Fair Labor Standards Act claims, along with trade secret and non-compete enforcement. Routinely spoke at large conferences such as the South Texas College of Law Labor and Employment Conference, the Texas A&M Law Review Energy Law Symposium, HR Southwest and the Gulf Coast Symposium on HR. Texas Lawyer published dozens of articles about employment law. Legal experience matched this thought leadership. Extensive experience in non-compete and trade secret litigation. Resolved DTPA claim concerning a big-rig truck. Mediated DTPA claim concerning allegations that lawn service killed an entire lawn and landscaping. Resolved DTPA claim concerning the construction of a metal building for a small business. Resolved putative FLSA collective action. Resolved numerous similar FLSA and contract breach suits against a set of defendants in the disaster recovery industry. Resolved a 7-figure employment contract dispute against a public company in the search engine and enterprise AI industry. Resolved construction disputes about payment, delay, or defects. Resolved a trade secret dispute in the construction industry. Resolved joint interest billing claim involving a large public exploration and production company. Resolved a malpractice claim against a title company and its principle. Resolved a dispute among the owners of a business, allowing them to do business independently. Resolved a dispute about an allegedly defective shipment of product in the cosmetic industry. Resolved a multi-party dispute over a contract in the shipping industry.

Careful listening undergirds my mediation style. Written mediation statements play an important role. Preliminary-mediation calls are also arranged with counsel, unless counsel feels a call is unnecessary. Before the mediation session, I encourage the parties to exchange a non-confidential component of their mediation statements. I typically do not hold an opening joint session, although I prefer to begin with a joint session in more complex disputes. Both parties must have an appreciation for what continued litigation means to them, before they can evaluate resolving the dispute. My style often includes evaluative elements, although all parties' interests must be explored first. Many disputes require work with emotions that takes significant listening and reframing first.
