Hospitality industry: franchise and licensing agreements, development agreements, management contracts, food and beverage suppliers, service and vendor agreements, and guest-related incidents. Cannabis disputes: licenses, breach of management or distribution contracts, competition violations and diverted profits. Construction (commercial and residential): termination and delay claims; subcontractor claims; change order disputes; payment and performance; defective design/construction. Real estate (commercial and residential): acquisition, site development, construction and leasing. Land use disputes (e.g., adverse possession, easements, and border disputes). Hourly Rate: Not provided Daily Rate: $8,000.00 Study Rate: $600.00/hr Cancellation: Not provided Cancellation Period: Not provided Comment: Mediation rates are value-based and the flat fee covers all time related to a particular day of mediation, including: administrative, pre-mediation, and two hours of follow-up time (3 hours in multi-party matters). Flat rate includes any travel time/expenses. For work not covered by a flat mediation rate, an hourly rate of $600. applies. Cancellations: The deposit is fully refundable eight weeks prior to the mediation date, less any fees and costs. Within eight weeks of the mediation date, 50% of the flat rate is non-fundable. Within two weeks prior to the mediation date, the entire flat rate is non-refundable. Mediator reserves the right to cancel any mediation date where all fees have not been timely received. Continuances: The parties may continue the mediation up to eight weeks prior to the start of the mediation. For continuances made between eight and two weeks prior to the start of the mediation, the non-refundable deposit can be applied to the new date; however, a fee of $2,000, as compensation for lost time, is immediately due to continue the matter.
