Represented clients in international arbitration and contractual issues in cross-border sale of goods (commodities and heavy equipment), energy (traditional and renewables) and the EPCs connected to power plants, solar and wind farms, manufacturing, construction, multi-jurisdictional arbitration-related proceedings, SaaS, technology distribution and licensing and technical services, aviation leasing, defects in heavy machinery and ships, laycans / demurrage / berthing disputes in shipping, real estate development loans and construction. Experienced in technology and licensing issues, oil and gas operations, numerous chemical businesses, production sharing agreements (PSAs), liquefied natural gas (LNG) projects as well as LNG-related agreements including gas transportation issues such as pipelines and LNG tankers, cross-border acquisitions and divestitures.

Mediator Experience
Served as a mediator on three matters, with mediation held in Vietnam, Singapore and New York, involving construction and shareholder disputes in the energy, renewable energy and retail sectors.
Acted as advocate in over 10 mediations, including mediation agreed upon in the middle of arbitration, with amounts in dispute ranging from US$500,000 to US$50 million, involving construction, energy, payment in share purchase agreements, liquidated damages disputes.
Representative Issues Handled as a Mediator
Issues include delay claims, Covid-19-related interruptions, proper shareholding structure in jurisdictions where nominee shareholding is prohibited, and fraudulent misrepresentations.
Mediator Style & Process Preferences
Pre-mediation briefs will be requested in advance of the mediation session. General approach is to hold a caucus first with all parties and counsel involved, provide an overview of the mediation process. I then instruct the parties and counsel to transfer to their designated break-out rooms as I move from one room to the other as the main part of the mediation process.
Familiar with handling virtual mediation sessions including joint sessions with the parties.
I approach each mediation as if it were my first mediation and attempt to learn all I can about the dispute prior to the mediation. I respect party autonomy in mediation and only share my views of the respective parties' positions as a neutral when requested or when it appears that it will assist with resolution.
Technology Proficiency
Familiar with managing ESI and willing to conduct arbitration hearings in-person, via video conference, or hybrid formats. Willing to receive all submissions and evidence in electronic format (paper submissions are neither required nor desired). Familiar with various AI-driven tools for research.

Comment: For travel rate - to be incurred only if spent studying the case. If not, travel time shall be chargeable at half the hourly rate of $600, i.e. $300.
For cancellation:
On vacation of hearing dates less than 24 weeks before date fixed for commencement of hearing - 30% of hourly rate for each hour set for the hearing dates;
On vacation of hearing dates less than 12 weeks before date fixed for commencement of hearing - 50% of hourly rate for each hour set for the hearing dates;
On vacation of hearing dates on or after the date for commencement of hearing - 75% of hourly rate for each hour set for the hearing dates.
