Mediator Style & Process Preferences

Styles are dynamic and selected ex temporaneous depending on the parties and also their familiarity/comfort and the time of day/fatigue. Styles sometime shift depending on topics or stages where negotiations tend to be more controlled/focused with parties being asked to focus on points offered and countering and responding to points; rather than losing focus by being open ended. For commercial matters or legally nuanced matters: evaluative and practical. Emphasis on ensuring parties are on levelled playing fields, and pursue realistic offers for settlement. For sensitive matters such as family, workplace harassment, disputes, etc. or where there are highly confidential matters which parties do not necessarily want to disclose in mediations (such as in patent matters, trade secrets, settlements without admission of liability, etc.) transformative and facilitative styles are typical with more control and shuttled processes/caucuses. Where existing relationships apply and have a practical impact on the dispute, a facilitative and open ended approach so that parties may have a safe space to express themselves without filters, with my role being to interrupt only if necessary to regain respect, focus or prevent harm. Emotional and personal contributions are welcomed if appropriate and practical so long as parties are willing and do not feel intimidated or weakened or guilted.

Technology Proficiency

Very proficient and willing to conduct ADR sessions in persons, via teleconferences or other technological means, or using hybrid formats.
