Forty three years of experience: trial lawyer (six years), corporate counsel (six years), Circuit Court trial judge (16 years), Indiana Supreme Court Justice (12 years), Mediator/Arbitrator and Senior Judge (three years). Twenty eight years of active and reserve service in the United States Army, with two post 9-11 mobilizations to Iraq and Guantanamo Bay. Served as Prosecutor, Defense Counsel, Staff Judge Advocate, Legal Advisor, Training Officer, Staff Judge Advocate, Commander, Military Judge, Chief Judge, Chief Defense Counsel and Ethics Officer. Retired as an Army Colonel in 2010 when appointed as an Indiana Supreme Court Justice.

As a practicing attorney - personal injury cases, malpractice cases, family law cases, employment disputes, contractual disputes as well as general business litigation matters. In addition, experienced in criminal matters. As corporate counsel - experience with business disputes, acquisitions, divestiture, contracts, employment related matters and litigation, environmental issues, regulatory matters, IRS and other taxing entities. As trial court judge - presided over 30,000 cases ranging from misdemeanors to capital murder, from paternity and family law matters to class actions and other complex civil matters. As a Supreme Court Justice - authored over 100 published majority opinions and over 100 dissenting opinions (more majority opinions and more dissenting opinions than any other Justice serving during that same time period). As a Mediator/Arbitrator - family law and paternity cases, property disputes, will contests and estate litigation, personal injury matter, business litigation, complex civil litigation and pre-litigation matters.

Experienced in multi-case mediations with common issues and/or some common parties. Have conducted several multiple party mediations over the last three years with parties including individuals, government entities and businesses. These mediations have occurred over several sessions in various locations depending on needs of the parties. The majority of these multi-case or multi-party mediations have reached settlement in part, if not on all pending issues. Experienced in a variety of mediation issues, including personal injury and wrongful death matters, will contests, contract disputes, family and paternity cases and employment matters. As with the multi-party matters, these mediations involve individuals, estates, businesses and government entities. Family and Civil Mediation Training completed in 2023.

Family law and civil cases, mediating a variety of issues from large marital estates, custody and parenting time to commercial business disputes, school related matters, trusts and pre-suit litigation. Issues relating to parties who dislike each other very much, financial impediments to settlements, multiple parties and coordinating a path forward for all, making certain parties are being heard and feel included, establishing a legitimate rapport with the parties, asking relevant and helpful questions of attorneys and their clients.

In-person mediations are preferred, but I also understand virtual mediations may be needed depending on the relationship and location of parties. I am very experienced in virtual mediations and am also willing to host mediations in one of our office locations or travel to any mutually agreeable location. I request confidential mediation statements 48 hours prior to the start of mediation. I can also be available for conference calls if that will be helpful for attorneys or in reaching a settlement. I take this work very seriously and work with the respective attorneys to learn their challenges and how I can help them most effectively. I also understand the importance of “connecting” to the participants and pride myself on my skill set and ability to establish the much-needed rapport, credibility and trust with everyone I work with. I also find it most helpful to be able to draw on my significant experience as an attorney, trial court judge and Supreme Court Justice and my many experiences in the military and in my life.

Zoom – regularly used for attorney conferences, scheduling conferences, hearings and mediations; open to any platform and open to conducting in-person ADR or zoom or other virtual ADR. Understand project management, payroll, and other forms of Learning Management Systems. Understand accounting and financial systems and am familiar with and have worked with electronically stored information. Have used AI in assisting with research and organization.
