Background as a principal investor and dealmaker, rather than solely as outside counsel or advocate, provides direct familiarity with the commercial pressures, information asymmetries and relationship dynamics that typically underlie disputes in private equity, fund management, banking, real estate, hospitality and infrastructure finance contexts. Particular interest and developing focus on disputes arising across the private equity deal lifecycle, including pre-closing disputes (such as disagreements over material adverse change provisions and conditions to closing), post-closing price adjustment disputes (completion accounts and locked-box mechanisms), warranty and indemnity claims (including disputes intersecting with W&I insurance), and fund-level disputes between general partners and limited partners (including carry, waterfall and clawback issues, and NAV valuation disagreements). Experience in distressed investment and restructuring-related disputes, including intercreditor and capital structure issues relevant to cross-border Asia-Pacific situations. Extensive experience as a party and principal (rather than as counsel) in negotiating and resolving commercial disagreements in the ordinary course of private equity investment, joint venture management and banking transactions, including shareholder disputes, valuation disagreements, and counterparty negotiations across multiple Asian jurisdictions. This includes disputes and negotiations arising in real estate and hospitality ventures, REIT asset acquisitions, brand licensing and franchise arrangements, and retail distribution and supply chain relationships.

Mediator Style & Process Preferences

Pre-mediation calls with each party are requested to understand the commercial context and each side's priorities before the joint session. Position papers or short briefs are welcomed in advance but are not mandatory, particularly where parties prefer a more informal, business-oriented process. I view mediation as fundamentally a commercial exercise in identifying and bridging the real interests underlying a dispute, rather than a procedural rehearsal of legal positions. Drawing on direct experience as a principal investor and dealmaker, I am comfortable engaging with parties on the underlying commercial and financial logic of a dispute, not only its legal framing, and use this where helpful to test the practicality of proposed positions. Generally, I favour an initial joint session to frame the issues, followed by private caucus sessions to explore interests, constraints and settlement options candidly. I respect party autonomy throughout and offer evaluative input on commercial or technical issues only when invited to do so or where it is likely to assist parties toward resolution. Comfortable conducting mediations virtually or in person, and able to accommodate multi-party processes involving co-investors, lenders, or other stakeholders typical of private equity and project finance disputes.

Technology Proficiency

Proficient and willing to conduct mediation sessions and conferences using Zoom, Microsoft Teams and other standard virtual meeting platforms, including multi-party virtual caucus sessions. Comfortable working with electronically shared documents and data rooms, consistent with experience managing due diligence and transaction documentation in private equity and banking practice. Compensation

Hourly Rate: Not provided Daily Rate: $2,000.00 Study Rate: $250.00/hr Cancellation: $1,000.00/Day Cancellation Period: 7 Days Comment: First two hours of study time included in the flat day rate, with additional study time billed at $250/hour. Any necessary travel to be reimbursed at actual cost for reasonable out-of-pocket expenses agreed with the parties. All mediator fees and expenses are to be shared equally among the participating parties unless otherwise explicitly agreed in writing or ordered by a court/arbitral tribunal. A fully refundable deposit covering the estimated study time and hearing time must be received from each party 14 days prior to the mediation date. Any unused portion of the deposit will be promptly refunded within seven business days of the conclusion or termination of the mediation.
