Mediator Style & Process Preferences

The mediators role is to help the parties find the resolution that they have been unable to find by themselves. I have been successful in presenting solutions from "outside the box" that helped resolve that parties finally come together. Because of both the technical and emotional nature of construction related disputes, mediation is by far the best and most efficient process for resolving them. It is the mediator’s role to provide a framework for the parties to address their issues and to assist them in working toward resolution. My approach to a particular mediation varies depending on the circumstances. I always study the submitted contract and mediation demands before accepting an assignment. I will also research the parties and the issues to ensure the process will continue to move forward. I usually like to address any emotional issues upfront then move to the more complex and technical issues once everyone has had their say. The most important thing I ask from the parties is their heartfelt desire to resolve the issues.
