Handled numerous mediations as a defendant and plaintiff advocate. Focus as a mediator has been primarily, but not limited to, intentional torts, auto and trucking negligence, premises liability, homeowner disputes, professional liability, landlord tenant, indebtedness, attorney fees, NIL disputes.

Representative Issues Handled as a Mediator

Primary mediation issues include establishment of negligence in various matters, injury causation, economic and non-economic damages, medical billing issues, insurance coverage questions, discriminatory practices, damages to property, and compensation for lost wages.

Mediator Style & Process Preferences

In all cases, but especially those in litigation, it is important to listen openly and without judgement in an attempt to understand the pressures and aims of all the participants including attorneys, insurance professionals and, most importantly, the parties. In this way, a mediator can best elevate and maintain the right of self-determination of the parties. I encourage the parties to share as much information as possible and take full advantage of the confidentiality mediation provides. I request the parties submit pre-mediation statements or to schedule phone conferences to discuss the basics of the case prior to the proceeding. This process is an effective way for the parties to focus in on the issues and it helps the mediator determine communication strategies and procedures which might make the settlement discussions more effective. There should be no unsuccessful mediations. Even when an impasse is reached, the parties should leave with a better understanding of the issues, risks, rewards, possible agreement on some facts, and movement toward a closer point of settlement for further negotiations.

Technology Proficiency

Proficiency with Zoom, Teams, and hybrid uses of technology. Majority of mediations conducted via the Zoom application. In person mediations and those combined with Zoom are also possible. Lexis/Protege legal research utilized for issue research and preparation when appropriate.
